Terms of Service

1. Service Description
Hirecast ("we", "us", "our") provides managed AI agent services. Each customer receives a dedicated, isolated AI agent running in a private container. Agents can be accessed through Slack, Google Chat, and other supported messaging platforms. The agent operates on behalf of the customer within its private workspace.
2. Acceptance of Terms
By accessing or using the Hirecast service, you agree to be bound by these Terms of Service. If you are using the service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
3. Subscription Terms
- Paid plans are billed at $750 per month per agent. Billing is recurring and charged monthly via Stripe.
- Free trials are available for 5 days per agent. Trial agents have the same capabilities as paid agents. At the end of the trial period, the agent will be paused unless converted to a paid subscription.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.
- We reserve the right to change pricing with 30 days' written notice.
4. Data Handling
- All customer data (files, conversations, configurations) resides in the customer's private container workspace.
- We do not sell, share, or distribute customer data to third parties for marketing or advertising purposes.
- Messages routed through our platform are processed solely to provide the AI agent service.
- LLM requests are sent to third-party AI providers (currently via OpenRouter) to generate agent responses. These requests contain the conversation context necessary for the agent to respond. See our Privacy Policy for details.
5. Customer Responsibilities
You are responsible for:
- All activity that occurs within your agent's workspace and through your connected messaging accounts.
- Ensuring that your use of the service complies with all applicable laws and regulations.
- Maintaining the confidentiality of any API keys, tokens, or credentials you provide to the service.
6. Acceptable Use
You agree not to use the service to:
- Violate any applicable law or regulation.
- Generate, store, or distribute illegal, harmful, or abusive content.
- Attempt to access other customers' containers, data, or infrastructure.
- Engage in activities that could damage, disable, or impair the service or interfere with other customers' use.
- Use the service for cryptocurrency mining, denial-of-service attacks, or other resource-abuse activities.
- Resell access to the service without written authorization.
7. Intellectual Property
You retain all rights to the data and content you create, upload, or generate using the service. We retain all rights to the Hirecast platform, software, and infrastructure. The AI-generated content produced by your agent is owned by you.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The service is provided on an "as-is" and "as-available" basis. We may perform maintenance that temporarily affects service availability, and will provide reasonable advance notice when possible.
9. Termination
- You may terminate your account at any time by canceling your subscription and requesting account deletion.
- We may suspend or terminate your access if you violate these terms, fail to pay, or if continued service poses a risk to other customers or our infrastructure.
- Upon termination, your container and workspace data will be retained for 30 days, after which it will be permanently deleted.
10. Limitation of Liability
To the maximum extent permitted by law, Hirecast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the service.
Our total aggregate liability for any claims arising from or related to the service shall not exceed the amount you paid to Hirecast in the 12 months preceding the claim.
11. Disclaimer of Warranties
The service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated responses will be accurate, complete, or suitable for any particular purpose.
12. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or through the service. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
13. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
